Needs

We were instructed by the leaseholder to act as their agent during the Dilapidations negotiations /claims. The client was in the process of completing works and had engaged our services to challenge items and costs they believed were outside their lease. Our client felt the landlord and their surveyor were requesting works to be undertaken outside the repairing covenants of the lease.

What
We Did

Our service included undertaking a site survey of the property, reviewing all provided documentation on the unit such as the schedule of dilapidations and the lease and also negotiating with the landlord surveyor.

Project Complexities

There were vague covenants within the lease which caused differing interpretations of lease wording by both sides.

Project Outcome

Our survey found several defects; the client was aware of one of the defects but not the extent and the other defect which had not been flagged during their viewings of the unit or the sale agent. We provided advice to the client on the scope of these defects, liabilities on signing the lease with these defects outstanding and initial scopes & cost estimates for remediation works. The client is still in the process of negotiating with the landlord and has requested that we obtain quotes to reinstate.
